惩罚性损害赔偿制度在英美法系国家由来已久,可我国直到现在还未真正建立这一制度,这不仅是我国法律制度中的缺憾,还使得现实生活中种种不公平现象无法得以解决。我们应借鉴国外的惩罚性损害赔偿制度,早日建立我国的惩罚性损害赔偿制度。

The institution of punitive damages came out in the common law legal family long before.However,it has still been absent in our country until now,which not only flaws our legal system but also makes several unfair cases in real life unsolved.This article tries to elaborate on the current situation that the institution of punitive damages hasn't existed in our country yet and propose to establish it as soon as possible.
