中国金融业对外的招商引资所产生的中外资本一体共生的局面并非我们所渴求的金融改革,因为金融业事关我国家安全的本性决定了在一个国家内某些资源是不能出让的。我国对这种行为持许可态度的法律规则不仅显示出了一种对民族资本的自贱心态,而且它体现出的是一种法律价值泛化。虽然法律文明无疆域,但是法律的价值却是有边界的。中国法律价值的研究不仅应定向于传统的价值观念,而且更应将维系我民族国家安全作为传统法价值的前提。

It is not the expected financial refonn when Chinese financial industry begins to sell their stocks so as to create a co-existence with foreign capital, because the natural attributes of finance has determined that some resources can't be sold to foreigners. The present related rules have shown not only the self-subtracting inclination towards national capital, but a transcendence of legal values. Though legal culture has no boundary, legal values does have boundaries. Thus, research on the legal values shouldn't stick to the conventional legal values, but should be extended to the safety of our country.
