试用买卖是一种特种买卖。我国《合同法》在170条和171条首次对其进行了规定。这些规定过于简单,仅涉及试用期间和试用买卖效果的规定,对于承认、标的物风险负担、试用期间的法律后果及其试用费用承担等方面规定有必要进一步研讨并完善。

Sales transaction on trial use is a sale of special type.Our Contract Law makes the stipulations on it in the first time in Article 170 and Article 171.But those two articles are rather simple and they only involve in periods of trial use and effect on sales transaction on trial use.They have not any explicit stipulations on the risk bear,cost of period of trial use and some other issues,and those are not favorable for the dispute settlement in this field.Therefore they should be perfected.
