在我国城市化、工业化的进程中,大量农村集体所有土地通过国家征收的方式成为新的用地来源,而现行立法中对征地的前提——"公共利益"的抽象界定容易导致政府权力的失控及农民土地权益的受损。鉴于此,明确程序控制在界定"公共利益"过程中的重要意义,将"公共利益"纳入土地征收听证程序并且在"公共利益"的界定过程中实现司法机关的介入,完善相关立法是解决当前实际问题的有效途径。

A large quantity of land which is collectively owned by peasants is becoming a new source of land for construction by land expropriation during the progress of urbanization and industrialization. But the definition of "public interests" which is the precondition for government to implement land expropriation is too abstract. As a result,the power of government will lose control and infringe on the peasants' land rights. So it is necessary to clarify the importance of procedural control in the progress of defining the "public interest". To solve the problems mentioned above,we should make the activity of defining "public interest" as a part of hearing process and have the judiciary involved in the progress of defining "public interest" and modify relational legislation.
