要充分发挥量刑建议在认罪认罚案件中的“基石”作用,必须实现量刑建议与量刑裁决的良性互动。这种良性互动,既关乎被追诉人认罪认罚后“从宽”利益的兑现,也关乎认罪认罚案件能否实现快速处理,甚至关乎检法关系的未来走向。量刑建议与量刑裁决的良性互动,虽有理论根基、规范依据和检法关系的协同趋向作为逻辑起点,但也受制于量刑建议的方式选择、司法审查的宽严把握以及二审抗诉的理由认知等诸多因素。为此,既需要检察机关努力提升量刑建议的质量,也需要法院在变更量刑建议时受到更为规范的程序约束,还需要检法理性看待被告人认罪认罚后的上诉行为。
