The registration of trust property could define the scope of trust property as well as the rights and obligations of trustors, beneficiaries and trustees. The effect of registrations is not to give birth to the effect of a trust, but to deny the claims from a third party. The establishment of China Trust Registration Company in the later 2016 and the issuance of Trust Registration Administration provisions and its detailed rule display centralized efforts to institutionalize trust product registration and a platform for the flotation of trust beneficial rights. However, trust product registration may be an unnecessary and nonsufficient condition for trust property registration. The lack of certainty and uniqueness of trust property and the lack of legal personification of trust, the lack of correspondence between trust product and trust property will constitute difficulties in the building of a registration system. The trust property registration could also be achieved in a moderately scattered approach through various ways for the sake of transaction safety. It is better to utilize the traditional property registration system to add trust information. Escrowing the property with a third party could be viewed as de facto trust property registration. It is desirable to enhance the obligation of inquiring potential trust property right for certain trading parties in special areas.
