Review of Chief Procurator Attendance in Judicial Committee System

Abstract

The involvement of chief procurator in Judicial Committee is not in conformity with the spirit of principles of criminal procedure comprising the equality of arms,the neutrality of trial,the independence of trial and the presumption of innocence,and it is contrary to the ideology of procedural justice; not only would the abuse of trial superintendence be caused but also it would give rise to a series of insuperable conflicts in practice,which intensifies the irrationality of the institution of Judicial Committee; there is no necessary links between the attendance of chief procurator in Judicial Committee and the exercise of trial superintendence; the Organic Law of the People's Courts should repeal this institution in its future amendment.
