长期以来,机动侦查权被视为检察机关履行法律监督职责的一项重要手段。2018年修改后的刑事诉讼法仍然保留了检察机关的此项权力。从既往的司法实践看,检察机关采用机动侦查权办理的案件数量不多,但不能据此简单地认为该项权力没有发挥实际作用。刑事诉讼法对机动侦查权的功能定位是适时监督,寻求个案正义,而非主动行权,对所有特殊案件大包大揽。机动侦查权未来的发展方向不是单纯地通过修法扩大案件的适用范围,而是在规范层面上针对机动侦查权的案件适用范围、审查程序、权力配置等办案中存在的瓶颈问题作出技术性破解,最终使该项权力发挥应有的作用。

Flexible investigation power of procuratorates makes a great role in the legal supervision. The criminal procedure law (amendment draft) has retained the flexible investigation power of procuratorates. From the perspective of judicial practice, the number of cases handled by procuratorates is limited, but it can't be simply considered that the power has not played a practical role. In fact, the position of flexible investigation power is timely to supervision, seek case justice rather than active right of action. The direction of the future development of the power of flexible investigation power is not to extend the scope of the case through the repair of the law, but to make a technical solution to the bottlenecks in the starting conditions of the motor investigation right, the procedure of examination and so on at the standard level, and finally implement the functional orientation of the flexible investigation power.
