社会主要矛盾的变迁意味着中国社会进入了新时代,也意味着行政法治体系必须作出相应变革以服务于新时代。为解决新时代“人民日益增长的美好生活需要和不平衡不充分的发展之间的矛盾”,行政法治体系必须进一步规范配置公共资源的权力,从而推进公共市场开放以实现充分发展,同时又要进一步规范政府配置公共资源的权力,从而解决民生问题以实现均衡发展。因此,新时代行政法治发展的关键方向在于有效规范政府的公共资源配置权。过往主要矛盾驱动下的行政法治体系在这一方面存在不足,既不能有效推动公共市场的开放化,又不能充分保障公民对公共资源的公平分享权以致民生更为失衡。为此,我们必须以公民公平分享权为中心,建构和完善公共资源分配法治以确保公共资源的公平分配与分享,从而推动均衡和充分发展的实现。

The vicissitude of social principal contradiction means that Chinese society has entered a new era, and it also means that the administrative rule of law system must make corresponding changes to serve the new era. In order to solve “the contradiction between people's increasing need for the good life and unbalanced, inadequate development” during the new era, administrative law system must further normalize the power of the allocation of public resources to promote the public markets open in order to realize the full development, and further normalize government power of the allocation of public resources to solve the problem of the people's livelihood so as to realize the balanced development of power. Therefore, the key direction of the development of administrative rule of law in the new era is to effectively regulate the government's right to allocate public resources. In this aspect, the administrative rule of law system driven by the previous principal contradiction has deficiencies. It cannot effectively promote the openness of the public market, nor can it fully guarantee citizens' rights to share public resources in a fair way, so that people's livelihood becomes more unbalanced. Therefore, we must construct and perfect the rule of law of public resources distribution with the fair sharing right of citizens as the center to ensure the fair distribution and sharing of public resources, and promote the realization of balanced and full development.
