  • Comparision between China and America on Legal Security System for Technology Originality

    Through making comparison between China and America on legal security system for technology originality,this article points out the current situation and problems of technology originality in China and holds that the relative measures of policy and law from the government for reference are required to change such a situation and solve the said problems,which includes subject relation,government management,fiscal support,technology transfer and judicial protection in respects of technology originality.In this way,the legal security system of technology originality means the policy and law environment beneficial to technology originality.

    Alternative Trading Systems(ATSs) are electronic trading systems based on the internet,non-intermediary media and automatically bring together and match multiple securities orders of buyers and sellers belonging to non-discretionary rules,and are the product of computerization of securities exchange,which belong to the category of curb exchange.Compared with the traditional stock exchanges,ATSs have non-discretionary exchange rules and particular relationship with the investors,and non-intermediary trade all kinds of securities with more efficiency.Compared with U.S.A and EU,China also has the market environment and conditions to set up ATSs,so we should encourage the establishment and development of ATSs in China,and scientifically construct the legal system of ATSs regulation in China from the aspects of objectives,principles,model of supervision and prudential requirements.
  • Freedom to Provide Services in the Context of EU Financial Services Law

    In EU financial services law,freedom to provide services,as one of the four fundamental economic rights in EC Treaty,provides all national measures that can restrict cross-border free movement of services.Such services can be provided either directly or by means of the physical movement of service providers.As for national rules under the public order exception or the general good exception,freedom to provide services constitutes the legilastive basis for the principles of minimum harmonization,mutual recognition and home country control.As for other national rules,it has the direct effect.In order to apply it properly,ECJ should conform to a set of rules of reasoning,to review the category,legitimacy and justification of specific national measures.With the further integration of EU financial services market,national private law rules with mandatory nature shall also fall in the scope of the freedom to provide services.
  • The Study on Exhibition Participation Objectives of Visitors: Factor Analysis & Cluster Analysis——Case Study of Trade shows at Dongguan City

    This research focuses on the contents & structures and categories of visitors' objectives in Dongguan when they participate exhibitions, which is a vacant research area in China. This paper take 5 trade shows hosted at Dongguan city as case studies. Findings from survey of 3630 visitors indicate that attendee non-purchasing objectives are more important than purchasing objectives, which support the previous international research results. Specifically, the structure of visitors; objectives can be categorized into four dimensions: information-searching, relation-building, incentive traveling and purchasing activity. Results also demonstrate that visitors of exhibition attending objectives have 3 categories: ambiguise objective ones, information-searching-oriented ones and multi-dimention-objective ones.

    This thesis makes deep analysis on the viewpoints that the managers' compensation's contract should be combined with the market achievement and accounting record,which has constructed an incentive compensation modal based on the increase in market value as the manager's achievement index.As a consult,this modal is quite usful for solving the problem of earning manipulation,brought by the manager's compensation merely depends on accounting record.Additionally it avoids the troubling problem that the lack of effect brought by the manager's compensation's contract merely depends on market performance.

    What is the assured meaning of the "亞" shape graphics in the Chinese primordial culture which often appears in some cultural relics such as relic bone inscription,Jinwen characters ancient graves,sundials,chessboards and so on ? Scholars have no unitive cognition on this problem in prehistoric civilzation.This treatise discusses how the ancients who lived in prehistorical culture elicited the concept of "亞" shape,and how the "亞" shape concept rose from the depiction of the shape of terra firma to a kind of psychic motif,from this discussion,the author summarized the unique universe view and ideology mode of ancient Chinese.The relation between the "亞" shape concept and the ancient proprieties system、the change of "亞" shape and the transforming of Chinese ancient society just is the concrete embodiment of the development of this universe view and ideology mode,among them contained the particular character of Chinese culture.The variations of the "亞" shape in different cultures offered us a possible clue to explore the contact among various cultures.The"亞" shape finally disappeared in eastern culture while became a kind of deiform symbol in western culture,we can generalize some differences between eastern and western cultures from this phenomenon.

    singing and dancing performance,talking art,asking and answering through acts and drama were four main forms to transmit Shiji.They were all between elegance and earthliness,and developed with times.Through performance,Shiji approached people's life,so it's rational spirit was accepted by people,and edified people through instruction in amusement.

    Carnivalization,one of Mikhail Bakhtin's key concepts,means polyphony,the centrifugal force of language,the gay interdepen dence of things,perspectivism and performance,participation in the wild disorder of life,the immanence of laughter.Carnivalization in Closing Time covers a wide range from the convolving and confusing conference of ACACAMMA to Milo Minderbinder's stealth bomber,from disordered metropolitan living,to a socialite wedding in the bus terminal.Closing Time illustrates carnivalization as an antisystem,a second life standing for postmodernism itself.This article interprets Closing Time on three levels: the carnivalization of world experience,the carnivalization of art thought,and the carnivalization of literary genres.

    In the historical narration of contemporary poetry,the most important parts would be Menglong poetry,the Third Generation poetry and the poetry of 1990s.But it was paradoxical that,in their most active period,they were actually placed at the edge of social and cultural life because of various reasons and criticism by many people.And it was more surprised that the more differences and contradictions had in themselves,the more stable their place in poetry history would be.This paper reviewed has several poetry controversy and would improv the understanding and the reflection on contemporary poetry and criticism.

    In the Chinese grammar field,there is a simplified tendency to summerize the thoroughness meaning of the action classifier bian(遍).This paper makes a deepgoing study of thoroughness meaning of bian,pointing out that it can show four meanings such as objective thoroughness,processive thoroughness,companied thoroughness,and metonymic thoroughness.It makes a investigation in its semantic selection of verb and the derivation process of thoroughness category.
  • A Tripartite Taxonomy of ES Meanings and the Limits of Translation

    From the perspective of the analytic philosophy of language,the present paper holds that translation is primarily concerned with the transfer of meaning,and that one's theory of meaning is often closely correlated with one's theory of translation.The paper mainly deals with the translation of experiential sentences(ES),the semantic content of which includes sentence meaning,speaker's meaning and phenomenal meaning.Generally,sentence meaning is readily translatable,speaker's meaning can be sufficiently conveyed though it may cause trouble for the translator when the writer/speaker intends to convey two meanings with one word,while phenomenal meaning may,though not necessarily,lead to weak untranslatability.

    In 1241,the emperor Wo KuoTai of Yuan Dynasty formally ordered to establish an institution named the Hospital of Tai as the highest national administration institution of the medicine.From then on,the medicine administration system of Yuan was founded,including interrelated law regulation of the medicine,we call it the Medicine Law now.The authors propose that because the system was not perfect,the Yuan Dynasty could not establish the independent administration institution of the medicine.It seemed that the government was eager to put it into practice,as well as trying to complete and adjust the system as the same time.But anyway,it was a part of law system of the Yuan,also the important content of the researching in the Yuan history.

    Da-Zhao Li went backwards from the Marxism stand when he joined with initiating the "Good-govemmenlism" in 1922. At the attempt to utilize Marxism on Chinese Revolution, Da-Zhao Li put forward the theory of Transforming rruitter and sold and the Proletarian China. On the other hand, the Communist Party of China hadn't formed unified thoughts and hadnH strict organization disciplines before the second National Congress. Because of all of these f Da-Zhao Li utilized the "Good-govemmentism" in 1922.
